Terms of Service

These Terms of Service govern your use of the MilkyWish app. By downloading or using the app you agree to be bound by these Terms.

1. Acceptance of Terms

By using MilkyWish you confirm you are at least 13 years of age, have the legal capacity to enter these Terms, and agree to comply with them. If you do not agree, do not use the app.

2. Description of Service

MilkyWish lets you draw a star, write a wish, and launch it into a shared sky where other users can see it and react to it.

3. User Content

You retain ownership of your star names, wish text, and drawings. By publishing you grant MilkyWish a worldwide, non-exclusive, royalty-free licence to store and display that content within the app for the star's chosen lifetime.

You agree NOT to publish content that is unlawful, hateful, harassing, obscene, or that infringes any third-party rights. We reserve the right to remove violating content without notice.

Wishes you publish are public while they are live: anyone can view them and share them, as an image of the wish and a link to it. Deleting a wish removes it and its share links; an image somebody has already shared elsewhere is outside our control.

Wishes are visible in the app and on milkywish.com.

4. Your Account

The app gives you a random account ID automatically, with no name or email. If you sign in with Apple, your stars stay with your Apple ID across devices. If you sign in on a phone where you already made wishes as a guest, those wishes move to your account.

5. Location Permission

The app requests "When In Use" location permission. Core features will not function without it. Location data is used as described in our Privacy Policy.

6. Acceptable Use

You agree not to use the app for unlawful purposes, attempt to reverse-engineer or tamper with the app, use automated scripts to publish stars, interfere with our servers, or attempt to access other users' data.

7. Intellectual Property

All app code, design, graphics, and branding (excluding User Content) are the property of MilkyWish. You may not copy, modify, or distribute any part of the app without prior written consent.

8. Star Expiry & Deletion

Stars are automatically deleted at the expiry date you choose. We reserve the right to delete content that violates these Terms at any time.

9. Disclaimers

The app is provided "as is" without warranties of any kind. You use the app at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, MilkyWish shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

11. Changes to Terms

We may update these Terms at any time. The date at the top indicates the last update. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, United States. Any dispute will be resolved in the courts of that jurisdiction.
